Terms of Service

These Terms of Service (“Terms”) govern your access to and use of powerhausbh.com (the “Site”) and the classes, memberships, packages, and related services offered by Power Haus Studios (“Power Haus,” “we,” “us,” or “our”). By using our Site or services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

Who May Use Our Services

You must be at least 18 years old to purchase memberships or packages and to enter into these Terms. Clients under 18 may participate only with the consent and, where we require it, the signed waiver of a parent or legal guardian, who accepts these Terms on their behalf.

Accounts and Bookings

Reservations, memberships, and payments are handled through our third-party booking provider, Mariana Tek. You are responsible for the accuracy of the information in your account and for keeping your login credentials confidential. Classes are subject to availability, and we may add, change, or cancel classes, schedules, or instructors.

Memberships, Packages, and Payment

Current pricing for single classes, class packages, memberships, and founder’s rates is shown on our Pricing page and is incorporated into these Terms. By purchasing, you authorize us and Mariana Tek to charge your payment method for the amounts and on the schedule described at checkout. Class packages expire on the timeline shown at purchase, after which unused classes are forfeited. Intro offers are available to new clients only. All sales are final and, except where required by law, payments are non-refundable and non-transferable.

Auto-Renewal and Cancelling a Membership

Memberships auto-renew monthly until you cancel. Monthly memberships carry a 3-month minimum commitment. Unused classes do not roll over and expire at the end of each 3-month commitment period. After your commitment period, your membership continues on a month-to-month basis and will automatically renew each month, charging your payment method on file, until you cancel. Founder’s rates remain locked only while your membership stays active; if you cancel a founder’s rate, it is forfeited and cannot be reinstated. To cancel or make changes, contact us at info@powerhausbh.com before your next renewal date. Cancellation stops future renewals but does not refund charges already made or the current commitment period.

Cancellations, Late Cancellations, and No-Shows

Please cancel or reschedule a reserved class at least 12 hours before it begins. Cancellations inside the 12-hour window are treated as late cancellations and, together with no-shows, incur the fees listed on our Pricing page. Late cancellations and no-shows may also forfeit the class credit used to book. These policies help us offer your spot to another client in time.

Health, Fitness, and Assumption of Risk

Reformer pilates is a physical activity. You should consult a physician before beginning any exercise program, and you agree to participate only within your own limits. You are responsible for disclosing any injuries, medical conditions, pregnancy, or other circumstances that may affect your participation, and for stopping if you feel unwell. Grip socks are required on the reformer. You participate voluntarily and at your own risk, and to the fullest extent permitted by law you assume all risk of injury and release Power Haus from claims arising out of your participation. A separate liability waiver may be required before your first class.

Studio Etiquette and Conduct

We want the studio to feel calm and welcoming for everyone. Please arrive on time, follow instructor guidance and equipment instructions, and treat staff, other clients, and the space with respect. We may refuse service, cancel a reservation, or suspend or terminate an account for conduct that is unsafe, disruptive, or in violation of these Terms.

SMS / Text Messaging Program

The following terms apply to our text messaging program. By opting in, you agree to them.

1. Program Description

By opting in, you agree to receive recurring automated text messages from Power Haus Studios (“we,” “us,” “our”) at the mobile number you provided. Messages may include appointment and class reminders, schedule changes and waitlist notifications, account and membership alerts, promotional offers, and customer support follow-ups. Consent to receive these messages is not a condition of any purchase.

2. Message Frequency

You may receive up to 6 messages per week. Message frequency may vary depending on your activity and interactions with us.

3. Message and Data Rates

Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan.

4. How to Opt Out and Get Help

You can unsubscribe from the SMS service at any time by replying STOP to any message we send you. After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again using the original opt-in method or reply START. For help or more information at any time, reply HELP to any of our messages. 5. Carrier Liability Disclaimer

Carriers are not liable for any delayed or undelivered messages.

Intellectual Property

The Site and its content, including text, graphics, logos, the Power Haus name and marks, photography, and design, are owned by or licensed to Power Haus and are protected by intellectual property laws. You may not copy, reproduce, or use them without our prior written permission.

Third-Party Services

Our services rely on third parties, including Mariana Tek for booking and payments and Google Maps for location. Your use of those services is subject to their terms and privacy policies, and we are not responsible for third-party services or content.

Disclaimers

The Site and our services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Power Haus and its owners, staff, and instructors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the Site or participation in our services. Where liability cannot be excluded, it is limited to the amount you paid to us in the 12 months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Power Haus and its owners, staff, and instructors from any claims, losses, or expenses (including reasonable legal fees) arising out of your use of the Site or services, your violation of these Terms, or your violation of any rights of another.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising out of these Terms or our services will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site or our services after an update means you accept the revised Terms.
